May 18, 2020 – STERLING , CO – King Jared and Dean Williams have failed to protect Sterling Correctional Facility, leaving the residents of Northeast Colorado vulnerable. Safe in their ivory towers, the governor and his executive director of Colorados Department of Corrections sit congratulating themselves while the citizens of Northeastern Colorado are left to correct the mess of their colossal failures.

Governor Polis and Jill Ryan – his Colorado Department of Public Health and Environment right-hand henchwoman – issued a Stay-at-Home order on March 25th yet continued to move inmates in and out of prisons until April 10th. This unbelievable oversight put our prison workers, inmates, and communities at risk for more than two weeks. Continue reading

STERLING, CO – April 7, 2020 – The Colorado Supreme Court has decided with a 4-to-3 vote that when the Governor declares an emergency, Colorados Constitution can be ignored.

The Majority found that the amendment to the Constitution detailing legislative session length is ambiguous, and that the legislative rule applied when the Governor declared a health emergency could be followed instead of the Constitution.  That’s right: a joint rule of the General Assembly has been found to be superior, legally, to the Constitution.

Here’s what the Constitution says: regular sessions of the general assembly shall not exceed one hundred and twenty calendar days.

STERLING, CO – October 28, 2019 @ 5am MT – In an era of money-hungry government, this election cycle seeks to move us further down a path asking taxpayers to give more, fund more, pay more.

Water has long been at the forefront of my agenda over the duration of my career in the state legislature. I have served as the Water Committee Chairman several times and have become one of those “water guys” from whom others seek information.

I have remained publicly neutral on Proposition DD as several questions were not answered. Instead, I proposed policy changes to require transparency. Those questions remain unclear and any transparency policy has so far been rejected.

This proposition asks permission to add sports betting to Colorado’s current list of approved games, in response to the 2018 Supreme Court ruling that individual states can authorize betting on sports. I know people who already bet using their smart phones.

Voters are asked to approve that list and then allow a tax on sports betting with the revenue going to the “Water Plan.”

On the surface this seems great: we need to make sure we have funding available to build storage and keep Colorado’s water in Colorado. Except, just like Prop CC, the legislature can raid funds set aside for water and use them for something else. And they have in the past – since 2002, $322 million dollars specified for water projects has been spent elsewhere.

If Prop CC fails and Prop DD passes, will the legislature take the money they had hoped would be generated by Proposition CC to fund the ongoing government overspending? The law says they can!

Let’s assume that we can trust the legislature to spend this money on the “Water Plan.” Will that money be used to build storage? Or will it fund other projects such as removing water from agriculture for recreation or instream flows or urban growth? A past director of the Colorado Water Conservation Board has been quoted saying that some rivers need to be 100% owned by the state to meet the agency’s conservation goals. That scares me and it should scare agriculture!

Most recently, as I try to decide if this is a good policy for Colorado, I can’t help but focus on the questions that are not being answered. It would appear that there are some hidden agendas involved.

To me, it boils down to this: should gamblers be made to fund our water needs? Should we raise taxes on something like gambling to replace a noticeable reduction in water funds used because of the curtailed oil and gas production? Can we trust the legislature to spend this money on what it is promised for?

I can’t answer yes to any of those questions.

Do you look forward to an annual tax refund check? Or do you want to donate your tax refund to the government? That is just what Referendum CC is asking you to do – forever.

It says “without raising taxes” and technically, there is no tax rate increase but the government will keep more of your money which means you will pay more in taxes and have less in your bank account to spend on things that you or your family might need.

The politicians hope that you don’t remember that when Referendum C passed in 2005, it was to go to education and highways. Funny how, now, Referendum CC is to go for basically the same things. Continue reading

When I started in the legislature 13 years ago, there was integrity and collaboration. You could disagree but still have a discussion and still be civil to each other. You would try to find common ground and actually try to solve problems. Now, not so much.

We have a governor who bragged about a stakeholder process for the new oil and gas restrictions when, in fact, there was none– no enviros– no industry. Integrity meant working with constituents to draft problem-solving language. Drafting any legislation in back rooms and then being dishonest when it is introduced is not the definition of good policy making, let alone integrity.

The evil seems to be a continued agenda with absolutely no desire to reach across the aisle to form good policy. From the introduction of bills which would create safe places to inject illegal drugs with new needles given by government to giving our Presidential votes away to the populated states, this governor and lawmakers are taking Colorado down a path of destruction and socialism.
